Kazakhstan Mulls Separate Penalties for Graffiti: Artists Urge Not to Confuse Street Art with Vandalism

The Ministry of Internal Affairs of Kazakhstan is drafting legislative amendments following government directives. The Repas graffiti community strongly supports combating vandalism and illicit drug ads, but urges lawmakers to clearly separate destructive tagging from legitimate urban street art.

Kazakhstan may soon introduce distinct administrative and criminal classifications specifically targeting unauthorized graffiti. While municipal authorities grapple with property defacement, illicit synthetic drug advertisements sprayed on residential facades, and aggressive tagging, prominent street artists warn against sweeping prohibitions that could stifle urban visual culture.

Why Authorities Are Reopening the Graffiti Debate

In major cities like Almaty and Astana, municipal utilities spend millions of tenge annually power-washing and painting over illegal tags. The primary driver of the renewed legislative push, however, is not artistic expression, but the proliferation of “drug graffiti” — stenciled URLs and QR codes directing teenagers to illicit darknet drug marketplaces.

Lawmakers argue that current legal mechanisms (such as petty hooliganism or deliberate property destruction under the Administrative Code) are either too lenient or ill-suited to effectively deter organized tagging and drug distribution syndicates.

Repas: Drug Tags, Signatures, and Murals Are Fundamentally Distinct

Artists from Repas, Kazakhstan’s most celebrated street-art collective with more than 15 years of institutional history, emphasize the necessity of precise legal taxonomy:

  • Illicit Drug Stencils (Narco-Graffiti): Criminal activity punishable under anti-narcotics statutes, having zero relation to art.
  • Vandalism / Destructive Tagging: Fast spray-can scribbles on historical monuments, public transit, or private storefronts without consent.
  • Urban Murals and Authorized Street Art: Curated artistic works that beautify blind architectural facades, celebrate cultural figures (like Abai, Viktor Tsoi, or Shaken Aimanov), and enhance city identity.

Artists Advocate for Transparent Consultation and Legal Walls

Community leaders call on municipal administrations (akimats) to establish “Hall of Fame” free-painting zones — designated legal walls and industrial parks where young artists can hone aerosol techniques without trespassing or damaging property.

Repas co-founder Andrey Voronchikhin cautions against overly punitive, blanket legislation that fails to involve artists and architects in public working groups. Without legal creative outlets, total bans simply drive youth culture deeper underground, worsening urban blight rather than solving it.

The Paradox: Using Authorized Art to Combat Vandalism

Cities around the world have demonstrated that blank, drab concrete walls are natural magnets for chaotic tagging. When a wall is transformed by high-quality, professional street art or cultural murals, the unwritten street code generally discourages tagging over the artwork, effectively protecting the building envelope.

Finding a balanced legislative formula that penalizes malicious vandalism while fostering vibrant, globally admired street art remains the central challenge facing Kazakhstani policymakers.
