When a bank collects overdue loan debt, at least 101,702 tenge must remain in the borrower’s current accounts — twice the subsistence minimum in 2026 (er10.kz). This protection does not automatically apply to every debit or account freeze. The amount is calculated across all current accounts held at the same bank. Different rules apply to debt collection through enforcement proceedings.

How much money must a bank leave when a loan is overdue?

The amount a borrower must be left with during this type of debt collection is called the minimum protected balance. In 2026, it is 101,702 tenge. This is the money that must remain in the accounts after overdue bank debt is collected.

This balance protects money for everyday expenses. However, the amount itself does not mean that every demand to collect money is subject to the same limit. Whether the protection applies depends on the type of account and the grounds for the debit.

What must remain after a missed payment

How is the balance calculated if you have several accounts?

The protected amount is calculated across the borrower’s current accounts at the same bank. The rule does not provide for a separate balance of 101,702 tenge in each account.

Having more accounts at one bank therefore does not increase the protected amount. When checking a debit, you need to consider the combined balance of the current accounts at that bank.

Does the protection cover savings accounts?

The rule applies to current accounts. It does not cover savings accounts, so you cannot rely on it to keep the same amount in a savings account.

The term “protected balance” does not, in itself, mean that all of a borrower’s money in a bank is protected. First, you need to establish what type of account the debt is being collected from.

Do you still have to repay the loan if you have a protected balance?

Yes. Having a protected amount does not release the borrower from the obligation to repay the debt. The overdue debt remains outstanding.

In other words, the balance determines how much money must remain in current accounts during this type of debt collection. The obligation to repay the bank remains in force.

Does the protected balance apply when an enforcement officer collects the debt?

If money is collected under a collection order during enforcement proceedings, different legal provisions apply. This is a separate legal basis for collecting money from an account.

The promise that 101,702 tenge will be left in an account therefore cannot be extended to every account freeze or debit. Protection during the collection of overdue bank debt does not provide the same automatic guarantee when a collection order is carried out.

What changes is the National Bank proposing?

The National Bank has announced plans to introduce a requirement to preserve the subsistence minimum when collection orders are received. Another proposal concerns account freezes: if a debtor has several accounts, the bank would have to freeze the required amount in one of them.

These proposals concern a separate debt collection procedure. They cannot be treated as an existing guarantee that money will be preserved whenever an account is frozen.

What to check if money has been debited to repay a debt

Start by checking the account type and the grounds for collection. If current accounts at the same bank are involved, consider their combined balance. Separately, establish whether the debit is linked to enforcement proceedings.

Put simply, 101,702 tenge is the protected balance for a specific type of overdue bank debt collection. Check now which account the money was taken from and on what grounds: this determines whether the protection applies.
